Numina: Terms of Use

By downloading, installing, or using Numina ("the App"), you agree to the following terms. Numina is intended for children, so these terms are meant to be read and accepted by a parent or guardian. If you do not agree, do not use the App.

1. License

Top 7 Systems ("we", "our", "us") grants you a limited, non-exclusive, non-transferable, revocable license to use Numina for personal, non-commercial purposes on any Apple device that you own or control, subject to the Apple Media Services Terms and Conditions.

2. Eligibility and Parental Consent

Numina is designed for children aged 8 to 11. A parent or guardian is responsible for supervising a child's use of the App, for deciding whether to enable optional features such as iCloud sync, and for accepting these Terms on the child's behalf.

3. Acceptable Use

You agree to use Numina in compliance with all applicable laws. You may not:

• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App in any unlawful way or to infringe the rights of others
• Interfere with or attempt to disrupt the App's normal operation

4. Educational Content Disclaimer

Numina is a learning game designed to build arithmetic skills and confidence. It is a supplement to, not a replacement for, formal schooling, a teacher, or a tutor. While the App is built on widely studied learning principles, we do not guarantee any specific educational result, grade, or test outcome, as learning depends on many factors outside the App.

5. Pricing and Purchases

Numina is free and contains no advertising. It does not currently offer in-app purchases. If in-app purchases are introduced in the future, they will be processed by Apple through the App Store and subject to Apple's terms, and refund requests would be directed to Apple.

6. Data and Storage

Numina stores its data on your device, and, if you enable it, in your own private iCloud account. We do not host or have access to this data. You are responsible for maintaining your own backups. We are not liable for any data loss resulting from device failure, app deletion, disabling iCloud, or any other cause.

7. Disclaimer of Warranties

Numina is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or uninterrupted, or that it will meet your specific requirements.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Top 7 Systems, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the App, or any other matter relating to the App.

9. Indemnification

You agree to indemnify and hold harmless Top 7 Systems from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

10. Intellectual Property

Numina and all associated branding, artwork, design, and code are owned by Top 7 Systems. These Terms do not grant you any right to our trademarks or content beyond the license to use the App.

11. Termination

We reserve the right to terminate or suspend access to the App at any time without notice if you breach these Terms. You may stop using the App at any time by uninstalling it.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Top 7 Systems operates, without regard to its conflict of law provisions.
