Ascent: Terms of Use

By downloading, installing, or using Ascent ("the App"), you agree to the following terms. If you do not agree, do not use the App.

1. License

Top 7 Systems ("we", "our", "us") grants you a limited, non-exclusive, non-transferable, revocable license to use Ascent for personal, non-commercial purposes on any Apple device that you own or control, subject to the Apple Media Services Terms and Conditions.

2. Eligibility

Ascent is designed for students aged 13 and up. If you are a minor in your jurisdiction, a parent or guardian must review and accept these Terms on your behalf, and is responsible for supervising your use of the App, including any purchase.

3. Acceptable Use

You agree to use Ascent in compliance with all applicable laws. You may not:

• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App in any unlawful way or to infringe the rights of others
• Interfere with or attempt to disrupt the App's normal operation

4. Educational Content Disclaimer

Ascent is a learning game designed to build Algebra 1 skills and confidence. It is a supplement to, not a replacement for, formal schooling, a teacher, or a tutor. While the App is built on widely studied learning principles and its content is checked for mathematical correctness, we do not guarantee any specific educational result, grade, or test outcome, as learning depends on many factors outside the App.

5. Pricing and Purchases

Ascent is free to download and free to play through Camp One. A single optional in-app purchase, the Full Expedition, unlocks the rest of the course. It is a one-time purchase, not a subscription, and it supports Family Sharing and Ask to Buy. Promotional offer codes may be made available from time to time at our discretion.

All purchases are processed by Apple through the App Store and are subject to Apple's terms. We never receive your payment details. Refund requests are handled by Apple and should be directed to Apple through your App Store purchase history.

6. Data and Storage

Ascent stores its data on your device, and, if you enable it, in your own private iCloud account. We do not host or have access to this data. You are responsible for maintaining your own backups. We are not liable for any data loss resulting from device failure, app deletion, disabling iCloud, or any other cause. The Full Expedition unlock is tied to your Apple ID and can be restored through the App Store even if local data is lost.

7. Disclaimer of Warranties

Ascent is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or uninterrupted, or that it will meet your specific requirements.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Top 7 Systems, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the App, or any other matter relating to the App.

9. Indemnification

You agree to indemnify and hold harmless Top 7 Systems from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

10. Intellectual Property

Ascent and all associated branding, artwork, design, and code are owned by Top 7 Systems. These Terms do not grant you any right to our trademarks or content beyond the license to use the App. The summit certificate the App renders is yours to share personally, but not to sell or use commercially.

11. Termination

We reserve the right to terminate or suspend access to the App at any time without notice if you breach these Terms. You may stop using the App at any time by uninstalling it.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Top 7 Systems operates, without regard to its conflict of law provisions.
